In January 2009 the federal government through its Centers for Medicare & Medicaid Services (CMS) imposed a new bond aimed at curbing medical equipment and supplies fraud. Manufacturers and suppliers of durable medical equipment, prosthetics, orthotics and supplies, aka DMEPOS, are required by the federal government  to provide a $50,000 DMEPOS bond. The bond is also known as the Medicare Bond.

Parties That Need DMEPOS Bonds:

Bonds are required from all professionals and businesses dealing with the federal government, medical and non medical practitioners. This includes physicians, nurses, midwives, counselors and social workers, dietitians or nutritionists, and medical assistants. A bond in that amount is required for each location that has separate National Provider Identifier number. Also, higher bonding limits may be required from businesses/ professionals who legal actions were taken against them in the past ten years. These legal actions include felony convictions, losing Medicare billing privileges, suspension or revocation of accreditation or licensing, and the exclusion of the business from any federal or state healthcare program.

DMEPOS Bonding Exemptions

Certain professionals may be exempt from the bond requirements. These may include the following:

1. Professionals in a private practice in a business that is solely-owned and operated by them if the items are furnished to their own patients as part of their own services.
2. The business/ professionals are only billing for the orthotics, prosthetics and supplies, with no other bills.
